The referral fee agreement is a broker-to-broker recommendation form. A recommendation between brokers and is not to be confused with a Finder`s Fee agreement, as a discoverer is an unlicensed person who finds clients for a broker and his agent. [See Form RPI 115] Normally, these fees are paid between brokers and real estate agents establish “cooperation agreements” to streamline the referral and payment process. In principle, the agent can pay a broker according to an already existing contract. Although not authorized by the California Department of Real Estate (DRE) or a real estate trading association, finders are allowed by state codes to promote potential buyers, sellers, borrowers, lenders, tenants, or landlords to make transfers to real estate agents, agents, or principals….
